Copyright and Terms of Use


  1. This Alberta Tourism Digital Assets Library contains images of Alberta (the "images") in high-resolution .jpg format and are made available to tourism industry and operators - including: travel writers, media representatives, and other travel trade representatives for use in promotion of Alberta as a tourism destination.

  2. Images are available at no cost, and may be reproduced for the following purposes:
    • promotional materials, not intended for retail sales, such as brochures promoting a specific area and/or all of Alberta
    • convention and trade show materials, not intended for retail
    • articles for newspaper and magazines featuring the province of Alberta
    • web sites promoting Alberta and/or to create awareness
    • social media promoting tourism to Alberta

  3. Images cannot be used for commercial purposes. For example, the following types of uses are prohibited:
    • materials related to tobacco, alcohol and religious or moral issues
    • retail items or materials intended for sale such as books, calendars, postcards, place-mats, screen savers, or souvenirs (e.g., T-shirts, playing cards, water bottles)
    • packaging or promotion of products intended for sale
    • personal and commercial letterhead and promotional materials
    • materials designed for interior decoration
    • materials used for partisan political purposes
    • advertising materials to promote non-tourism related business

  4. The images are the property of Her Majesty the Queen in Right of Alberta as represented by the Minister of Alberta Tourism, Parks and Recreation (the "Minister") or other contributors with all rights reserved except those expressly given under this Agreement.

  5. The images are protected by Canadian copyright law, trade-mark law and international treaties.

  6. This is a license given by the Minister to you as the user for a one- time use for the images you have selected and will include in the order form, and accompanying written material for a single use consistent with these terms and conditions.

  7. You may not alter the images electronically or otherwise or create derivative works. For example, you cannot misrepresent a location or create a false image by placing the Rocky Mountains in an Edmonton Skyline. However, cropping, sizing and creating montages are allowed.

  8. You are authorized to make one copy of the image for back-up or archival purposes only if you reproduce all copyright and other proprietary notices that accompany the image.

  9. Anytime an image appears in print, credit must be given to Travel Alberta or the photographer (as outlined with each image).

  10. You may not rent, lease, or sublicense the image but you may transfer all of your interest in it, accompanied by written materials, if you retain no copies and the recipient agrees to the terms of this license.

  11. Images reproduced on the Internet may only be used at 72 dpi or lower.

  12. In no event will the Minister be liable to you for any claims, costs, losses or damages, you incur by using the Images.

  13. Copying the images and the material in whole or in part, except according to the terms and conditions of this license, is forbidden without prior written permission from Alberta Tourism, Parks and Recreation.

  14. Alberta Tourism Digital Assets Library materials cannot comprise more than 50% of the image content of any commercial guide book, CD, DVD or video.

Limitation of Liability
Under no circumstances, including, but not limited to, negligence shall the Government of Alberta be liable for any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use of, or the inability to use, the website and/or the materials.

Termination
The Government of Alberta may terminate this agreement, including any licenses contained herein, at any time and further may terminate the user's access to any and all portions of this website if, the Government of Alberta determines, in its sole discretion, that the user failed to comply with any term of these Terms of Use. Upon termination, the user must cease use of this website and destroy all materials obtained from this website, and all related documentation and all copies thereof, whether made under these Terms or otherwise, and/or take any additional or alternative reasonable steps that the Government of Alberta may direct in respect of the termination of the use.
